Employers Requesting Access to Employees’ or Applicants’ Social Media Profiles

On the topic of employers or organizations requesting access to employees’ or applicants’ personal social media profiles, here are a few of my initial thoughts:

Social Media LoginIt appears to me that a user (the applicant) is committing a violation of the terms of service (TOS) agreement by providing a 3rd party (the potential employer), who did not accept the terms of service for the service and account, with a login and password to access the service. So, the possible employer is requesting (or requiring) the candidate to violate the terms of a contract, breach system security and possibly violate telecommunications laws. It’s unethical and unlawful.
